General Terms Of Use
HOBBIDO GENERAL TERMS OF USE
The terms and policies below refer to the use of the hobbido.com website (“Website”), “Hobbido” mobile application (“Mobile Application”) and any of their related products and services (collectively, “Hobbido Platform”). These Terms & Policies are legally binding agreements between you (“User”, “you” or “your”) and hobbido Inc. (“hobbido Inc.”, “Hobbido”, “we”, “us” or “our”). By accessing and using the Hobbido Platform, you acknowledge that you have read, understood, and agree to be bound by the terms of these Agreements. If you are entering into this Agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this Agreement, in which case the terms “User”, “you” or “your” shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this Agreement, you must not accept this Agreement and may not access and use the Hobbido Platform. You acknowledge that this Agreement is a contract between you and hobbido Inc., even though it is electronic and is not physically signed by you, and it governs your use of the (“Hobbido Platform”).
We reserve the right to modify these Agreements or their terms relating to the Hobbido Platform at any time, effective upon posting of an updated version of these Agreements on the Hobbido Platform. When we do, we will send you an email to notify you. Continued use of the Hobbido Platform after any such changes shall constitute your consent to such changes.

- ACCEPTABLE USE POLICY
- Prohibited activities and uses
You may not use the Hobbido Platform to publish content or engage in activity that is illegal under applicable law, that is harmful to others, or that would subject us to liability, including, without limitation, in connection with any of the following, each of which is prohibited under this Policy:
- Distributing malware or other malicious code.
- Disclosing sensitive personal information about others.
- Collecting, or attempting to collect, personal information about third parties without their knowledge or consent.
- Distributing pornography or adult related content.
- Promoting or facilitating prostitution or any escort services.
- Hosting, distributing or linking to child pornography or content that is harmful to minors.
- Promoting or facilitating gambling, violence, terrorist activities or selling weapons or ammunition.
- Engaging in any unlawful acts or violating any international, federal, provincial or state regulations, rules, laws or local ordinances
- Engaging in the unlawful distribution of controlled substances, drug contraband or prescription medications.
- Harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate based on gender, sexual orientation, religion, ethnicity, race, age, national origin, or disability
- Managing payment aggregators or facilitators such as processing payments on behalf of other businesses or charities.
- Facilitating pyramid schemes or other models intended to seek payments from public actors.
- Threatening harm to persons or property or otherwise harassing behaviour.
- Misrepresenting or fraudulently representing products or services.
- Infringing the intellectual property or other proprietary rights of others.
- Facilitating, aiding, or encouraging any of the above activities through the Hobbido Platform.
- System abuse
Any User in violation of the Hobbido Platform security is subject to criminal and civil liability, as well as immediate account termination. Examples include, but are not limited to the following:
- Use or distribution of tools designed for compromising security of the Hobbido Platform.
- Intentionally or negligently transmitting files containing a computer virus or corrupted data.
- Accessing another network without permission, including to probe or scan for vulnerabilities or breach security or authentication measures.
- Unauthorized scanning or monitoring of data on any network or system without proper authorization of the owner of the system or network.
- Service resources
You may not consume excessive amounts of the resources of the Hobbido Platform or use it in any way which results in performance issues or which interrupts the Hobbido Platform for other Users. Prohibited activities that contribute to excessive use, include without limitation:
- Deliberate attempts to overload the Hobbido Platform and broadcast attacks (i.e. denial of service attacks).
- Engaging in any other activities that degrade the usability and performance of the Hobbido Platform.
- No spam policy
You may not use the Hobbido Platform to send spam or bulk unsolicited messages. We maintain a zero-tolerance policy for use of the Hobbido Platform in any manner associated with the transmission, distribution or delivery of any bulk e-mail, including unsolicited bulk or unsolicited commercial e-mail, or the sending, assisting, or commissioning the transmission of commercial e-mail that does not comply with the U.S. CAN-SPAM Act of 2003 (“SPAM”).
Your products or services advertised via SPAM (i.e. Spamvertised) may not be used in conjunction with the Hobbido Platform. This provision includes, but is not limited to, SPAM sent via fax, phone, postal mail, email, instant messaging, or newsgroups.
- Defamation and objectionable content
We value the freedom of expression and encourage Users to be respectful with the content they post. We are not a publisher of User content and are not in a position to investigate the veracity of individual defamation claims or to determine whether certain material, which we may find objectionable, should be censored. However, we reserve the right to moderate, disable or remove any content to prevent harm to others or to us or the Hobbido Platform, as determined in our sole discretion.
- Copyrighted content
Copyrighted material must not be published or used on the Hobbido Platform without the explicit permission of the copyright owner or a person explicitly authorized to give such permission by the copyright owner. Upon receipt of a claim for copyright infringement, or a notice of such violation, we will immediately conduct a full investigation. However, we generally require a court order from a court of competent jurisdiction, as determined by us in our sole discretion, to take down alleged infringing material from the Hobbido Platform. We may terminate the Service of Users with repeated copyright infringements. Further procedures may be carried out if necessary. We will assume no liability to any User of the Hobbido Platform for the removal of any such material. If you believe your copyright is being infringed by a person or persons using the Hobbido Platform, please get in touch with us to report copyright infringement.
- Security
You take full responsibility for maintaining reasonable security precautions for your account. You are responsible for protecting and updating any login account provided to you for the Hobbido Platform.
- Enforcement
We reserve our right to be the sole arbiter in determining the seriousness of each infringement and to immediately take corrective actions, including but not limited to:
- Suspending or terminating your Service with or without notice upon any violation of this Policy. Any violations may also result in the immediate suspension or termination of your account.
- Disabling or removing any content which is prohibited by this Policy, including to prevent harm to others or to us or the Hobbido Platform, as determined by us in our sole discretion.
- Reporting violations to law enforcement as determined by us in our sole discretion.
- A failure to respond to an email from our abuse team within 2 days, or as otherwise specified in the communication to you, may result in the suspension or termination of your account.
User accounts suspended or terminated due to violations will not be re-activated.
Nothing contained in this document shall be construed to limit our actions or remedies in any way with respect to any of the prohibited activities. We reserve the right to take any and all additional actions we may deem appropriate with respect to such activities, including without limitation taking action to recover the costs and expenses of identifying offenders and removing them from the Hobbido Platform, and levying cancellation charges to cover our costs. In addition, we reserve at all times all rights and remedies available to us with respect to such activities at law or in equity.
- TERMS AND CONDITIONS
- Accounts and membership
You must be at least 13 years of age to use the Hobbido Platform not including the Host Features details of which can be found in our “Host Terms of Use”By using the Hobbido Platform and by agreeing to this Agreement you warrant and represent that you are at least 13 years of age. If you create an account on the Hobbido Platform, you are responsible for maintaining the security of your account and you are fully responsible for all activities that occur under the account and any other actions taken in connection with it. We may occasionally monitor and review new accounts . Providing false contact information of any kind may result in the termination of your account. You must immediately notify us of any unauthorized uses of your account or any other breaches of security. We will not be liable for any acts or omissions by you, including any damages of any kind incurred as a result of such acts or omissions. We may suspend, disable, or delete your account (or any part thereof) if we determine that you have violated any provision of this Agreement or that your conduct or content would tend to damage our reputation and goodwill. If we delete your account for the foregoing reasons, you may not re-register for our Services. We may block your email address and Internet protocol address to prevent further registration.
- User content
We do not own any data, information or material (collectively, “Content”) that you submit on the Services in the course of using the Hobbido Platform. You shall have sole responsibility for the accuracy, quality, integrity, legality, reliability, appropriateness, and intellectual property ownership or right to use of all submitted Content. We may, but have no obligation to, monitor and review the Content on the Services submitted or created using our Services by you. You grant us permission to access, copy, distribute, store, transmit, reformat, display and perform the Content of your user account solely as required for the purpose of providing the Services to you. Without limiting any of those representations or warranties, we have the right, though not the obligation, to, in our own sole discretion, refuse or remove any Content that, in our reasonable opinion, violates any of our policies or is in any way harmful or objectionable. You also grant us the license to use, reproduce, adapt, modify, publish or distribute the Content created by you or stored in your user account for commercial, marketing or any similar purpose.
- Billing and payments
You shall pay all fees or charges for your purchases in accordance with the fees, charges, and billing terms in effect at the time a fee or charge is due and payable. If, in our judgment or by order of the authorities, your purchase constitutes a high-risk transaction, we will require you to provide us with a copy of your valid government-issued photo identification, and possibly a copy of a recent bank statement for the credit or debit card used for the purchase. We reserve the right to change our services and their pricing at any time.
- Accuracy of information
All published listings including (“Regular”, “Program”, “Activities”) collectively (“Listing” or “Listings”) on the Hobbido Platform by Host Users may occasionally contain typographical errors, inaccuracies or omissions that may relate to features, descriptions, pricing, availability, location, quantity, and others. Host users reserve the right to correct any errors, inaccuracies or omissions, and to change or update information, or cancel their Listings on the Hobbido Platform if found inaccurate at any time without prior notice (including after you have submitted your completed your booking of such Listings). in the event a Host User updates some or all of the information, or partially or fully cancels their Lists, which may affect your confirmed booking on that specific Listing, you will be immediately notified. You will be prompted to either accept or reject the changes If you reject the changes, you will be entitled to a full refund for the amount of your affected confirmed booking into your in-app wallet on the Hobbido Platform, as per the Cancellation & Refund Policy found within this document.
- Third party services
If you decide to enable, access or use third party services, be advised that your access and use of such other services are governed solely by the terms and conditions of such other services, and we do not endorse, are not responsible or liable for, and make no representations as to any aspect of such other services, including, without limitation, their content or the manner in which they handle data (including your data) or any interaction between you and the provider of such other services. You irrevocably waive any claim against Hobbido. with respect to such other services. Hobbido is not liable for any damage or loss caused or alleged to be caused by or in connection with your enablement, access or use of any such other services, or your reliance on the privacy practices, data security processes or other policies of such other services. You may be required to register for or log into such other services on their respective platforms. By enabling any other services, you are expressly permitting Hobbido to disclose your data as necessary to facilitate the use or enablement of such other service.
- Backups
We perform regular system backups of the Hobbido Platform and required infrastructure and will do our best to ensure completeness and accuracy of these backups. In the event of hardware failure or data loss we will restore backups automatically to minimize the impact and downtime.
- Disclaimer of warranty
You agree that the Hobbido Platform is provided on an “as is” and “as available” basis and that your use of the Hobbido Platform is solely at your own risk. We expressly disclaim all warranties of any kind, whether express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose and non-infringement. We make no warranty that the Hobbido Platform will meet your requirements, or that the Service will be uninterrupted, timely, secure, or error-free; nor do we make any warranty as to the results that may be obtained from the use of the Service or as to the accuracy or reliability of any information obtained through the Service or that defects in the Service will be corrected. You understand and agree that any material and/or data downloaded or otherwise obtained through the use of the Hobbido Platform is done at your own discretion and risk and that you will be solely responsible for any damage or loss of data that results from the download of such material and/or data. We make no warranty regarding any goods or services purchased or obtained through the Hobbido Platform or any transactions entered into through the Hobbido Platform unless stated otherwise. No advice or information, whether oral or written, obtained by you from us or through the Hobbido Platform shall create any warranty not expressly made herein.
- Advertisements
During your use of the Hobbido Platform, you may enter into correspondence with or participate in promotions of advertisers or sponsors showing their goods or services through the Hobbido Platform. Any such activity, and any terms, conditions, warranties or representations associated with such activity, is solely between you and the applicable third party. We shall have no liability, obligation or responsibility for any such correspondence, purchase or promotion between you and any such third party.
- Links to other resources
Although the Hobbido Platform may contain links to other resources (such as websites, mobile applications, etc.), we are not, directly or indirectly, implying any approval, association, sponsorship, endorsement, or affiliation with any linked resource, unless specifically stated herein. Some of the links on the Hobbido Platform may be “affiliate links”. This means if you access the link and/or complete a purchase, Hobbido will receive an affiliate commission. We are not responsible for examining or evaluating, and we do not warrant the offerings of, any businesses or individuals or the content of their resources. We do not assume any responsibility or liability for the actions, products, services, and content of any other third parties. You should carefully review the legal statements and other conditions of use of any resource which you access through a link on the Hobbido Platform. Your linking to any other off-site resources is at your own risk.
- Intellectual property rights
“Intellectual Property Rights” means all present and future rights conferred by statute, common law or equity in or in relation to any copyright and related rights, trademarks, designs, patents, inventions, goodwill and the right to sue for passing off, rights to inventions, rights to use, and all other intellectual property rights, in each case whether registered or unregistered and including all applications and rights to apply for and be granted, rights to claim priority from, such rights and all similar or equivalent rights or forms of protection and any other results of intellectual activity which subsist or will subsist now or in the future in any part of the world. This Agreement does not transfer to you any intellectual property owned by Hobbido or third parties, and all rights, titles, and interests in and to such property will remain (as between the parties) solely with Hobbido All trademarks, service marks, graphics and logos used in connection with the Services, are trademarks or registered trademarks of Hobbido or its licensors. Other trademarks, service marks, graphics and logos used in connection with the Services may be the trademarks of other third parties. Your use of the Hobbido Platform grants you no right or license to reproduce or otherwise use any trademarks belonging to Hobbido or third-parties.
- Limitation of liability
To the fullest extent permitted by applicable law, in no event will Hobbido, its affiliates, directors, officers, employees, agents, suppliers or licensors be liable to any person for any indirect, incidental, special, punitive, cover or consequential damages (including, without limitation, damages for lost profits, revenue, sales, goodwill, use of content, impact on business, business interruption, loss of anticipated savings, loss of business opportunity) however caused, under any theory of liability, including, without limitation, contract, tort, warranty, breach of statutory duty, negligence or otherwise, even if the liable party has been advised as to the possibility of such damages or could have foreseen such damages. To the maximum extent permitted by applicable law, the aggregate liability of Hobbido and its affiliates, officers, employees, agents, suppliers and licensors relating to the services will be limited to an amount greater of one dollar or any amounts actually paid in cash by you to Hobbido for the prior one month period prior to the first event or occurrence giving rise to such liability. The limitations and exclusions also apply if this remedy does not fully compensate you for any losses or fails of its essential purpose.
- Indemnification
You agree to indemnify and hold Hobbido and its affiliates, directors, officers, employees, agents, suppliers and licensors harmless from and against any liabilities, losses, damages or costs, including reasonable attorneys’ fees, incurred in connection with or arising from any third party allegations, claims, actions, disputes, or demands asserted against any of them as a result of or relating to your Content, your use of the Services or any wilful misconduct on your part.
- Severability
All rights and restrictions contained in this Agreement may be exercised and shall be applicable and binding only to the extent that they do not violate any applicable laws and are intended to be limited to the extent necessary so that they will not render this Agreement illegal, invalid or unenforceable. If any provision or portion of any provision of this Agreement shall be held to be illegal, invalid or unenforceable by a court of competent jurisdiction, it is the intention of the parties that the remaining provisions or portions thereof shall constitute their agreement with respect to the subject matter hereof, and all such remaining provisions or portions thereof shall remain in full force and effect.
- Dispute resolution
The formation, interpretation, and performance of this Agreement and any disputes arising out of it shall be governed by the substantive and procedural laws of Delaware, United States without regard to its rules on conflicts or choice of law and, to the extent applicable, the laws of United States. The exclusive jurisdiction and venue for actions related to the subject matter hereof shall be the courts located in Delaware, United States, and you hereby submit to the personal jurisdiction of such courts. You hereby waive any right to a jury trial in any proceeding arising out of or related to this Agreement. The United Nations Convention on Contracts for the International Sale of Goods does not apply to this Agreement.
- Assignment
You may not assign, resell, sub-license or otherwise transfer or delegate any of your rights or obligations hereunder, in whole or in part, without our prior written consent, which consent shall be at our own sole discretion and without obligation; any such assignment or transfer shall be null and void. We are free to assign any of its rights or obligations hereunder, in whole or in part, to any third party as part of the sale of all or substantially all of its assets or stock or as part of a merger.
- MOBILE APPLICATION LICENSE
- Use License
If you access the Hobbido Platform via our publicly published version of the mobile application, then we grant you a revocable, non-exclusive, non-transferable, limited right to install and use such mobile application on wireless electronic devices owned or controlled by you, and to access and use the mobile application on such devices strictly in accordance with the terms and conditions of this mobile application license contained in these Terms of Use. You shall not: (1) decompile, reverse engineer, disassemble, attempt to derive the source code of, or decrypt the application; (2) make any modification, adaptation, improvement, enhancement, translation, or derivative work from the application; (3) violate any applicable laws, rules, or regulations in connection with your access or use of the application; (4) remove, alter, or obscure any proprietary notice (including any notice of copyright or trademark) posted by us or the licensors of the application; (5) use the application for any revenue generating endeavour, commercial enterprise, or other purpose for which it is not designed or intended; (6) make the application available over a network or other environment permitting access or use by multiple devices or users at the same time; (7) use the application for creating a product, service, or software that is, directly or indirectly, competitive with or in any way a substitute for the application; (8) use the application to send automated queries to any website or to send any unsolicited commercial e-mail; or (9) use any proprietary information or any of our interfaces or our other intellectual property in the design, development, manufacture, licensing, or distribution of any applications, accessories, or devices for use with the application.
- Apple and Android Devices
The following terms apply when you use a mobile application obtained from either the Apple Store or Google Play (each an “App Distributor”) to access the Hobbido Platform: (1) the license granted to you for our mobile application is limited to a non-transferable license to use the application on a device that utilizes the Apple iOS or Android operating systems, as applicable, and in accordance with the usage rules set forth in the applicable App Distributor’s terms of service; (2) we are responsible for providing any maintenance and support services with respect to the mobile application as specified in the terms and conditions of this mobile application license contained in these Terms of Use or as otherwise required under applicable law, and you acknowledge that each App Distributor has no obligation whatsoever to furnish any maintenance and support services with respect to the mobile application; (3) in the event of any failure of the mobile application to conform to any applicable warranty, you may notify the applicable App Distributor (4) you represent and warrant that (i) you are not located in a country that is subject to a U.S. government embargo, or that has been designated by the U.S. government as a “terrorist supporting” country and (ii) you are not listed on any U.S. government list of prohibited or restricted parties; (5) you must comply with applicable third-party terms of agreement when using the mobile application (6) you acknowledge and agree that the App Distributors are third-party beneficiaries of the terms and conditions in this mobile application license contained in these terms, and that each App Distributor will have the right (and will be deemed to have accepted the right) to enforce the terms and conditions in this mobile application license contained in these terms against you as a third-party beneficiary thereof.
- DMCA POLICY
This Digital Millennium Copyright Act policy (“Policy”) applies to the Hobbido Platform and it outlines how we address copyright infringement notifications and how you may submit a copyright infringement complaint.
Protection of intellectual property is of utmost importance to us and we ask our users and their authorized agents to do the same. It is our policy to expeditiously respond to clear notifications of alleged copyright infringement that comply with the United States Digital Millennium Copyright Act (“DMCA”) of 1998, the text of which can be found at the U.S. Copyright Office website.
- What to consider before submitting a copyright complaint
Before submitting a copyright complaint to us, consider whether the use could be considered fair use. Fair use states that brief excerpts of copyrighted material may, under certain circumstances, be quoted verbatim for purposes such as criticism, news reporting, teaching, and research, without the need for permission from or payment to the copyright holder. If you have considered fair use, and you still wish to continue with a copyright complaint, you may want to first reach out to the user in question to see if you can resolve the matter directly with the user.
Please note that under 17 U.S.C. § 512(f), you may be liable for any damages, including costs and attorneys’ fees incurred by us or our users, if you knowingly misrepresent that the material or activity is infringing. If you are unsure whether the material you are reporting is in fact infringing, you may wish to contact an attorney before filing a notification with us.
We may, at our discretion or as required by law, share a copy of your notification or counter-notification with the account holder engaged in the allegedly infringing activity or for publication. If you are concerned about your information being forwarded, you may wish to hire an agent to report infringing material for you.
- Notifications of infringement
If you are a copyright owner or an agent thereof, and you believe that any material available on our Services infringes your copyrights, then you may submit a written copyright infringement notification (“Notification”) using the contact details below pursuant to the DMCA by providing us with the following information:
- Identification of the copyrighted work that you claim has been infringed, or, if multiple copyrighted works are covered by this Notification, you may provide a representative list of the copyrighted works that you claim have been infringed.
- Identification of the infringing material and information you claim is infringing (or the subject of infringing activity), including at a minimum, if applicable, the URL or URLs of the web pages where the allegedly infringing material may be found.
- Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an e-mail address.
- A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, the copyright owner’s agent, or the law.
- A statement that the information in the notification is accurate, and under penalty of perjury that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
- A physical or electronic signature (typing your full name will suffice) of the copyright owner or a person authorized to act on their behalf.
All such Notifications must comply with the DMCA requirements. You may refer to a DMCA takedown notice generator or other similar services to avoid making mistakes and ensure compliance of your Notification.
Filing a DMCA complaint is the start of a pre-defined legal process. Your complaint will be reviewed for accuracy, validity, and completeness. If your complaint has satisfied these requirements, our response may include the removal or restriction of access to allegedly infringing material as well as a permanent termination of repeat infringers’ accounts. We may also require a court order from a court of competent jurisdiction, as determined by us in our sole discretion, before we take any action.
If we remove or restrict access to materials or terminate an account in response to a Notification of alleged infringement, we will make a good faith effort to contact the affected user with information concerning the removal or restriction of access, which may include a full copy of your Notification (including your name, address, phone, and email address), along with instructions for filing a counter-notification.
Notwithstanding anything to the contrary contained in any portion of this Policy, Hobbido reserves the right to take no action upon receipt of a DMCA copyright infringement notification if it fails to comply with all the requirements of the DMCA for such notifications.
- Counter-notifications
A user who receives a copyright infringement Notification may make a counter-Notification pursuant to sections 512(g)(2) and (3) of the US Copyright Act. If you receive a copyright infringement Notification, it means that the material described in the Notification has been removed from our Services or access to the material has been restricted. Please take the time to read through the Notification, which includes information on the Notification we received as well as instructions on how to file a counter-notifications.
To file a counter-notification with us, you must provide a written communication that sets out the information specified in the list below:
- Identification of the material that has been removed or to which access has been restricted and the location at which the material appeared before it was removed or access to it was restricted.
- Information reasonably sufficient to permit us to contact you, such as an address, telephone number, and, if available, an e-mail address.
- A statement under penalty of perjury that you have a good faith belief that the material was removed or restricted as a result of mistake or misidentification of the material to be removed or restricted.
- A statement that you consent to the jurisdiction of the federal district court for the judicial district in which the address is located (or if you are outside of the United States, that you consent to the jurisdiction of any judicial district in which the service provider may be found), and that you will accept service of process from the person or company who provided the original infringement notification.
- A physical or electronic signature (typing your full name will suffice) of the copyright owner or a person authorized to act on their behalf.
Please note that you may be liable for, including costs and attorneys’ fees incurred by us or our users, if you knowingly misrepresent that the material or activity is not infringing the copyrights of others or that the material or activity was removed or restricted by mistake or misidentification. Accordingly, if you are not sure whether certain material infringes the copyrights of others or that the material or activity was removed or restricted by mistake or misidentification, you may wish to contact an attorney before filing a counter-notification.
Notwithstanding anything to the contrary contained in any portion of this Policy, hobbido Inc. reserves the right to take no action upon receipt of a counter-notification. If we receive a counter-notification that complies with the terms of 17 U.S.C. § 512(g), we may forward it to the person who filed the original Notification.
The process described in this Policy does not limit our ability to pursue any other remedies we may have to address suspected infringement.
- Reporting copyright infringement

- Representation
Any views or opinions represented on the Hobbido Platform belong solely to the content creators and do not represent those of people, institutions or organizations that Hobbido or creators may or may not be associated with in professional or personal capacity, unless explicitly stated. Any views or opinions are not intended to malign any religion, ethnic group, club, organization, company, or individual.
- Content and postings
You may not modify, print or copy any part of the Hobbido Platform. Inclusion of any part of the Hobbido Platform in another work, whether in printed or electronic or another form or inclusion of any part of the Hobbido Platform on another resource by embedding, framing or otherwise without the express permission of Hobbido is prohibited.
You may submit new content and comment on the existing content on the Hobbido Platform. By uploading or otherwise making available any information to Hobbido, you grant us the unlimited, perpetual right to distribute, display, publish, reproduce, reuse and copy the information contained therein. You may not impersonate any other person through the Hobbido Platform. You may not post content that is defamatory, fraudulent, obscene, threatening, invasive of another person’s privacy rights or that is otherwise unlawful. You may not post content that infringes on the intellectual property rights of any other person or entity. You may not post any content that includes any computer virus or other code designed to disrupt, damage, or limit the functioning of any computer software or hardware.
- Reviews and testimonials
Testimonials are received in various forms through a variety of submission methods. The testimonials are not necessarily representative of all of those who will use the Hobbido Platform, and Hobbido is not responsible for the opinions or comments available on the Hobbido Platform, and does not necessarily share them. All opinions expressed are strictly the views of the reviewers.
The testimonials displayed are given verbatim except for grammatical or typing error corrections. Some testimonials may have been edited for clarity, or shortened in cases where the original testimonial included extraneous information of no relevance to the general public. Testimonials may be reviewed for authenticity before they are available for public viewing.
- CHANGES, CANCELLATION AND REFUND POLICY
- Cancellation by User
You can access the booked services through the “My Bookings’ section of the Hobbido Platform, where you can view, cancel and request changes to your booking. Any changes from you will be as per the following terms.
All modifications, reschedules, changes and cancellations shall follow the local timing of the Hosting User. If the listing is made available for other users across different time zones, then it will be clearly mentioned on the listing.
- If you cancel a confirmed and paid booking more than 8 hours prior to the start time of the session as per the local time zone, the full amount paid will be refunded to the ‘in app’ user wallet hereafter referred to as “Hobbido Wallet”. You can use your Hobbido Wallet to book any other sessions on the Hobbido Platform.
- If you cancel a confirmed and paid booking within 8 hours of the start time of the session as per the local time zone, then a 50% cancellation penalty will be applied to the total amount paid. In the event the Host User finds a replacement equal to the total number of slots booked by you prior to the session starting the cancellation penalty will be waived and 90% of the total booking amount will be refunded to your Hobbido Wallet. The remaining 10% will be claimed by the Hobbido Platform to pay for payment processing charges.
- If you wish to cancel any unused prepaid sessions or program sessions, a penalty of 30% will be applied to the total amount of those sessions.
- Changes by User
There will be times where you will not be able to attend a confirmed and paid session due to any reason. In this case, you can reschedule the session to another date/time as per the availability of the Host User and the Listing. If there are no further scheduled sessions and you do not wish to attend the confirmed session. You may cancel your booking as per the terms mentioned in Section 6.1 of these terms.
- Non-refundable bookings
If any of the Listings on the Hobbido Platform are clearly described as “non-refundable” either by the Host User or by using a clear graphical messaging as “Non-Refundable” then it is non-refundable and the sale is final, and it will not be possible to change or cancel it after making a Booking.
- Changes made by the Host User
Occasionally a Host User may change the Listing which you have already have a confirmed booking on. This may include but is not limited to the session date/time, inclusions, location. coverage, age requirements, and/or any other features and/or requirements. Any changes made by the Host User will result in a notification being sent to you through the Hobbido Platform to the email address associated with your Hobbido Account. In this case, you can either accept or reject the changes. If you decide to reject the changes, then you will be prompted to cancel the booking and the full paid amount for that specific session will be returned to your Hobbido Wallet.
- Cancellation by the host
Although, we discourage Host Users from cancelling sessions or Complete Listings that already have confirmed attendees, due to certain situations they may be forced to do so. In this event, a User with a confirmed booking, will automatically receive a full refund for the paid session into their Hobbido Wallet. In case of prepaid packaged/program, you will receive refund for the unattended or redeemed sessions only.
- Refunds after the activity / experience has commenced
No refunds are available once a session has commenced
- Booking Disputes
If anything, unexpected comes up during your activity, generally it’s a good practice to try talking to the Host User first— generally most Host Users prefer to quickly resolve any issue by coming up with a solution, where possible.
But if the Host User can’t resolve the issue for you while the session is in progress, you can withdraw from the session and register a support ticket, which the Hobbido Team will investigate and provide a resolution accordingly. We require that you provide all required information related to your dispute with elaboration in order for us to understand the situation.
We take disputes very seriously and we try our best to solve all issues with the best results possible to ensure we have a satisfied and happy community.
Note that all disputes related to specific booking must be submitted within 72 hours from the start time of the booked session as per the local time zone of the listing and resolutions might take up to 14 days from the date of your submission.
- Discounted Bookings
If you make a discounted booking using a promocode, or if you accept a discount or special-offer price during the check-out process, your refund amount shall be equal to the amount paid after the discount. Note that promocodes are valid for certain periods, applicable to specific Host User services or some Listings. There are no guarantees that you will be able to book the same or other sessions using the same promotion code if no longer valid.
- Withdrawal of funds from the in-app wallet
Withdrawal of any funds existing in your Hobbido wallet, is processed manually by our support team and reviewed on a case-by-case basis. You can submit a support ticket through the Hobbido Platform and we will contact you further if additional information is required. Fund withdrawals, if approved, shall be processed to the original form of payment used which may take between 3 to 45 days depending on the Processing times of the other banking institution.
- Miscellaneous
In some situations, where refunds may not be possible, we may compensate you with a voucher which is considered as having monetary value and can be credited to your Hobbido Wallet.
- Withdrawal by Hobbido
We may decide, in our sole discretion, that it is necessary or desirable for the protection of our interests, the Host User interests and/or your interests, to stop, suspend or cancel part or full Listings or the Hobbido Platform resulting in an override of our cancellation and refund policy mentioned in these terms. We may also determine, in our sole discretion, to arrange refund to you part or all of the amounts charged to you. You agree that we and the applicable Host Users shall have no liability for such cancellations or refunds.
- TRAVEL & INSURANCE
- Country Entry Requirement
If your booking is for services listed in another country, you are responsible for ensuring that you meet all foreign entry requirements and that your travel documents, including passports and visas, are in order and you are allowed to access the destination country or city.
- Visa requirements
For applicable passport and visa requirements, you should consult the relevant embassy or consulate for information. Such requirements may change at any time, and it is your responsibility to check for up-to-date information before making a Booking and before your departure. Hobbido accepts no liability in connection with any person who is refused entry onto a flight or into any country, including countries such person may just be passing through en route to their final destination.
As visa and health requirements are subject to change without notice, Hobbido recommends that you verify health and visa requirements with the appropriate consulate prior to departure. It is also your responsibility to consult your physician for current recommendations on inoculations or vaccinations before you travel internationally, and to ensure that you meet all health entry requirements and follow all medical guidance related to your trip.
- Travel Insurance
Hobbido strongly recommends that you purchase a comprehensive travel insurance policy prior to departure to protect your purchases. If you cancel your trip or significantly alter travel dates, your travel insurance policy may reimburse the cost of cancellation fees and related expenses. Please review your travel insurance policy carefully for related terms and conditions.
Although most travel, including travel to international destinations, is completed without incident, travel to certain destinations may involve greater risk than others. Hobbido urges customers to investigate and review travel prohibitions, warnings, announcements and advisories issued by your own governments and destination country governments prior to booking travel to international destinations. Information on conditions in various countries and the level of risk associated with travel to particular international destinations can be found at www.fco.gov.uk , www.state.gov, www.tsa.gov, www.dot.gov, www.faa.gov, www.cdc.gov, www.treas.gov/ofac and www.customs.gov.
- Travel Disclaimer
HOBBIDO DOES NOT REPRESENT OR WARRANT THAT TRAVEL TO ANY DESTINATION IS ADVISABLE OR WITHOUT RISK, AND HOBBIDO IS NOT LIABLE FOR DEATH, DAMAGES OR LOSSES THAT MAY RESULT FROM TRAVEL TO SUCH DESTINATIONS.
- Hobbido Wallet
Hobbido Platform provides you with a virtual wallet to use throughout the platform also referred to as “Hobbido Wallet”. The use of the Hobbido Wallet is governed by the following terms
- Adding your Debit/Credit Cards
You may add as many Debit or Credit cards as you want to your Hobbido Wallet. You hereby consent and warrant that these cards either belong to you or you are explicitly authorized to use them by the original owner. You may not in any situation add any payment cards which you have obtained illegally from any other person. In the event we receive a notification or report for any fraudulent activities by your account, we will suspend your account and report it to the related authorities accordingly.
- Storing your Debit/Credit Cards Information
Although the Debit/Credit cards are added to your Hobbido Wallet, they are still solely and completely stored on your personal mobile phone or electronic device you are using to access the Hobbido Platform. You are solely responsible to secure your devices, information and details to prevent unauthorized access and use of your Hobbido Account and/or payment cards saved under your account.
- Wallet and Transaction fees
Hobbido does not charge any fees for maintaining funds in your Hobbido Wallet. However, third-party payment or money transfer services providers may charge for deposits and money withdrawals. For any matters related to transaction fees from such services providers, you can contact them directly and request their support.
- Your wallet, your money
All of the money that you have in your Hobbido Wallet whether from deposits using payment cards or credited to you via refunds or vouchers belongs to you and you may use such money to book any sessions throughout the Hobbido Platform without any restrictions.
- Prohibited Wallet Usage
You may not use Hobbido Wallet to conduct or engage in any illegal activities or others as mentioned in the acceptable use policy or in violation to any of these terms.
- Other Fees
Hobbido will charge you a total of 1$ or its equivalent in your local currency as a Service Charge during each checkout made through the Hobbido Platform. This amount is non-refundable
