Host Terms Of Use

The terms and policies below refer to the use of the hobbido.com website (“Website”), “Hobbido” mobile application (“Mobile Application”) and any of their related products and services (collectively, “Hobbido Platform”). These Terms & Policies are legally binding agreements between you (“User”, “you” or “your”) and hobbido Inc. (“hobbido Inc.”, “Hobbido”, “we”, “us” or “our”). By accessing and using the Hobbido Platform, you acknowledge that you have read, understood, and agree to be bound by the terms of these Agreements. If you are entering into this Agreement on behalf of a business or other legal entity, you represent that you have the authority to bind such entity to this Agreement, in which case the terms “Host User”, “you” or “your” shall refer to such entity. If you do not have such authority, or if you do not agree with the terms of this Agreement, you must not accept this Agreement and may not access and use the Hobbido Platform. You acknowledge that this Agreement is a contract between you and hobbido Inc., even though it is electronic and is not physically signed by you, and it governs your use of the (“Hobbido Platform”). The terms (“Hosting Services”, “Services”, “Listings”) refer to all the services that you will be providing under your Host User account to other users. Additionally, the terms (“User”, “Users”, “Attendee”, “Attendees”) refer to the other users booking and attending your listed Hosting Services.

This document constitutes an agreement with all users who are intending to use the hosting services provided by the Hobbido Platform. This document is considered as an appendix to the General Terms of Use that can be found here. The purpose of this document is to set the detailed terms, rules and regulations for Host Users on the Hobbido platform.

 

  1. Hosting on Hobbido

 

  • As a Host User, Hobbido offers you the opportunity to share your skills, experience, or other service with our community of users – and earn money doing it. It’s easy to create a Listing and you are in control of how you present and operate your hosting services – set your price, availability, and rules for each of your listings.

 

  • When you accept a booking request, or receive a booking confirmation through the Hobbido Platform, you are entering into a contract directly with the attendee, and are responsible for delivering your Hosting Services under the terms and at the price specified in your listing. You are also agreeing to pay applicable fees like Hobbido’s service fee(and applicable taxes if any) for each booking. The Hobbido Platform, as per the predefined fee for your account will deduct amounts you owe from your earning for each completed booking. Any terms, policies or conditions that you include in any supplemental contract with attendees must: (i) be consistent with this document and our General Terms of Use, and the information provided in your Listing, and (ii) be prominently disclosed in your Listing description.

 

  • Your relationship with Hobbido is that of an independent individual or entity and not an employee, agent, joint venturer, or partner of Hobbido. The Hobbido Platform solely acts as a payment collection agent as described in this document. Hobbido does not direct or control your Hosting Services, and you agree that you have complete discretion whether and when to provide such Hosting Services, and at what price and on what terms to offer them.

 

  1. Managing your Hosting Services Listing

 

  • The Hobbido Platform provides tools that make it easy for you to set up and manage a Listing. Your Listing must include complete and accurate information about your Hosting Services, your price, other charges such as equipment hire, transport fees, parking fees, venue access fees, venue accessibility, locker services, security deposits, offline fees, and any rules or requirements that apply to your attendees or Listing. You are responsible for keeping your Listing information (including calendar availability) and content (such as photos) up-to-date and accurate at all times. We recommend that you obtain appropriate insurance for your Host Services if your hosting includes activities such as off-shore excursions, high risk sports, activities unsafe in nature etc., and suggest you carefully review policy terms and conditions including coverage details and exclusions. You may maintain as many listings as you feel required, as long as it follows the Listing Terms in this document and that such listing is not repetitive.

 

  • You are responsible for understanding and complying with any laws, rules, regulations, and contracts with third parties that apply to your Listing or Hosting Services, for example private venues, public parks guidelines, local authorities and their applicable rules. Some countries have laws that restrict the provision of services without certification or licenses and it is your sole responsibility to obtain all required permissions in order to provide your Hosting Services. In some places, the Host Services you want to offer may be prohibited partially or in full particularly if it includes the serving of food, alcoholic beverages, unsupervised professional equipment that might lead to injuries. Some jurisdictions require that you register attendees who attend to some venues or go on excursions that may lead to leaving city boundaries or country borders or approaching official guarded locations. Some jurisdictions have laws that provide rights for attendees by default and apply additional obligations to the Host Users. We encourage you to always check your local regulations to learn what rules apply to the Host Services you plan to offer and ensure you comply with whatever is applicable to you. All of the information we provide regarding legal requirements is for informational purposes only and you should independently confirm your obligations. You are responsible for handling and using personal data of attendees and others in compliance with international and local applicable privacy laws, our General Terms of Use and this document. If you are still not sure or have questions about how local laws apply you should always seek legal advice.

 

  • The ranking of Listings on the Hobbido Platform depends upon a variety of factors, including these main parameters:
  • Guest search parameters (e.g. number of seats or slots, date or time location, and price range)
  • Listing category or subcategory, calendar availability, number and quality of images, reviews, type and regulations provided with the listing, Host rating or level.
  • Previous attendees’ booking experience (e.g. customer service and cancellation history of the Host User).
  • Host User requirements (e.g. equipment available at the location, transportation type, quality of transporting vehicle and other similar preferences that affects users’ decision), and
  • Guest preferences (e.g. locker room or restroom availability, wheelchair accessible, location convenience)

Search results may appear differently on our mobile application to how they appear on the website. Hobbido may allow Host Users to promote their Listings in the search or elsewhere on the Hobbido Platform by paying an additional fee. For more information about accessing featuring services or other marketing tools beneficial for your Hosting Services, you may reach us from the Help Center section on our Platform.

 

  • You are responsible and liable for your own acts and omissions. You are also responsible for the acts and omissions of anyone you allow to participate in providing your Hosting Services. You are responsible for setting your price and establishing the rules and requirements for your Listing. You must describe any and all fees and charges in your Listing description and may not collect any additional fees or charges outside the Hobbido Platform except those expressly disclosed beforehand in your listing. Do not encourage Guests to create third-party accounts, submit reviews, provide their contact information, or take other actions outside the Hobbido Platform.

 

  • If you co-host or host as part of a team, business, or other organization, the entity and each individual who participates in providing Hosting Services is responsible and liable for the account that is acting as a Host on the Hobbido Platform and should also follow these Terms. If you accept terms or enter into contracts, you represent and warrant that you are authorized to enter into contracts for and bind your team, business or other organization, and that each entity you use is in good standing under the laws of the place where it is established. If you perform other functions, you represent and warrant that you are authorized to perform those functions and you are authorized to transfer the payout and access the bank account detailed and provided by you on Hobbido Platform. In some situations, Hobbido’s Financial Team may request you to provide additional documents to allow you to continue using our Platform. Failure to provide such documents may lead to full account suspension.
  1. Your Assumption of Risk

 

You acknowledge that Hosting Services carries inherent risks and agree that you assume the entire risk arising out of your access to and use of the Hobbido Platform, offering Hosting Services, or any interaction you have with other Users whether in person or online. You agree that you have had the opportunity to investigate the Hobbido Platform and any laws, rules, regulations, or obligations that may be applicable to your Listings or Hosting Services and that you are not relying upon any statement of law made by Hobbido.

 

  1. Cancellations and Booking Modifications

 

Please refer to our General Terms of Use for detailed cancellation and refund policy.

 

  • If an attendee cancels a reservation within 8 hours of the start time of the confirmed booked session, then a compensation of 40% of the booking amount for that session will be automatically credited to your in-app Wallet. However, if you acquire a replacement booking before your session commences, that covers the number of slots cancelled by the User, then the funds will be returned to the original cancelling attendee.

 

  • Hosts and Attendees are responsible for any Booking Modifications they agree to make via the Hobbido Platform, and agree to pay any additional amounts, fees or taxes associated with a Booking Modification. The provision of inconsistent Hosting Services may also cause inconveniences and result in unnecessary costs for Users, which if claimed, may be deducted from your in-app wallet and paid to the User along with the refund for the total amount paid for the booking. If your in-app wallet does not hold enough credit to cover any of the costs claimed by Users as a result of your actions, then the negative amount will be posted in your in-app wallet and deducted from your future earnings, with the possibility of your Hosting Services being suspended until the amount due is paid in full.

 

  • If the User wishes to cancel a pre-paid session (Packaged Sessions) or a Program, then a refund will be possible for any unattended or unredeemed sessions at any time without a time rule. You will receive 20% of the total amount of the unredeemed sessions to your in-app wallet.

 

  • If you make a modification to any listing that holds a confirmed booking, and the modification is rejected by the confirmed attendee (User), the booking will be deemed cancelled and a full refund for that specific session will be automatically processed. For each cancellation of a session, that is the result of the rejection of changes or modifications you applied to your published listing, you will automatically be issued with a warning. Multiple warnings may over time cause your Hosting Services account to be temporarily or permanently suspended.

 

Hobbido reserves the right to take additional measures for its best interest and the best interest of its operations and its users and recover additional amounts from you due to your modification or cancellation whether it is partially or entirely for your Hosting Services listing.

  1. Taxes

 

  • As a host, you are responsible for determining and fulfilling your obligations under applicable laws to report, collect, remit, or include in your price any applicable VAT or other indirect taxes, income taxes, tourist, or other taxes (“Taxes“).

 

  • In jurisdictions where Hobbido facilitates the collection and/or remittance of Taxes on behalf of Host Users, you instruct and authorize Hobbido or (“hobbido Inc.”) to collect Taxes on your behalf, and/or to remit such Taxes to the relevant Tax authority. Any Taxes that are collected and/or remitted by Hobbido are identified to Host Users on their transaction records, as applicable. Hobbido may seek additional amounts from Host Users (by deducting such amounts from future payouts) in the event that the Taxes collected and/or remitted are insufficient to fully discharge that Host Users’ tax obligations, and you agree that your sole remedy for Taxes collected by Hobbido is a refund from the applicable Tax authority. You acknowledge and agree that we retain the right, with prior notice to affected Host Users, to cease the collection and remittance of Taxes in any jurisdiction for any reason.

 

  • In certain jurisdictions, Tax regulations may require that we collect and/or report Tax information about you, or withhold Taxes from payouts to you, or both. If you fail to provide us with documentation that we determine to be sufficient to support any such obligation to withhold Taxes from payouts to you, we may withhold payouts up to the amount as required by law, until sufficient documentation is provided. You agree that Hobbido may issue on your behalf invoices or similar documentation for VAT, GST, consumption or other Taxes for your Hosting Services to facilitate accurate tax reporting by you, our users, and/or their organizations.

 

  • If you’re a Host User whom the Internal Revenue Service (IRS) defines as a “US Person” and earn money from the Hobbido Platform, you need to report this income on your tax return. Your information may be collected using the W-9 Form which is embedded in our platform. However, all your personal information including the SSN is stored securely with our earning payout processor. It is the Host User’s responsibility to accurately fill the W-9 Form in order to activate the Hosting Services.

 

Qualifying Host Users will receive a form called the Form 1099-K (not to be confused with the more common 1099-MISC) Under the Internal Revenue Code Section 6050W, Hobbido with the assistance of our payout processor will file a Form 1099-K with the IRS for you, and you will receive a copy of your Form 1099-K to the email address associated with your account by the end of each year. The amounts calculated in your Form 1099-K will include all the earnings you received to your preferred payout method after deducting the Hobbido Platform fees. However, this also includes any additional fees that you might have paid to others to complement or fulfill your Hosting Services outside the Hobbido Platform.

 

Note: a 1099-K is a record of payments, not earnings. In accounting terms, this is a “gross income” rather than “net income”. Additionally, a 1099-K is applicable only for Host Users who receive a gross income of a total of USD20,000 on that year and at least 200 separate orders.

Examples

  • If a Host User received a total of USD20,000 as 200 payments of 100$ each, then the Host User will receive the 1099-K form.
  • If a Host User received a total of USD20,000 as 100 payments of 200$ each, then Host User will not receive the 1099-K form.

 

This document does not address all the tax issues for Host Users and it cannot and should not be relied upon as a legal or tax advice. Host Users are strongly encouraged to seek tax advice based on their particular circumstances from an independent tax advisor.

 

If you are not a US. Person, you are responsible for complying with the rules and regulations in your own jurisdiction. You may wish to consult with a trusted tax expert or advisor. Hobbido cannot provide tax advice.

 

  1. Payout and Financials

 

  • The Hobbido Platform will automatically collect the total amount after a User completes the checkout and payment processing for any booking. In the event where certain Listings are not set as ‘Instant Booking’ then Host Users must confirm each booking for the Users.

 

  • For one-time bookings under Regular Listings, your earnings generated from each booking will be transferred to your in-app wallet after 72 hours from the start time of a session. However, if the User raises a dispute or submits a support case related to that session, this will trigger a hold on the earnings from that session until the issue is resolved.

 

  • For prepaid packages and programs, your earnings will be immediately transferred upon successful payment collection from the Booking User. However, Hobbido reserves the right to recover any amount from your wallet, if you did not fulfill or deliver the confirmed sessions paid for by the users on your Listings.

 

  • During registration, you must provide all information related to your selected Payout Method. Failure to provide the required and accurate information may result in delaying or suspending the Payout of your earnings. Hobbido or our Payout Processor may request additional verification or information during registration or any time before processing the Payout of your earnings. You need to duly provide such information as needed.

 

  • Approved forms of verification documents include but are not limited to any valid 2-Sided National ID or Driving License, the first page of your Passport, Credit Card Statement, Address Verification, 2-Sided Temporary or Permanent residence permit

 

  • All Payouts are processed in US Dollars by default unless otherwise facilitated by our Payout Processor, you may request the Payout in other currencies. If other currencies are requested, an exchange fee may be applicable and other deductible applied by other banking institutions. Hobbido does not provide any financial advice, and we encourage all Host Users to consult their bank before processing their Payouts.

 

  • You hereby authorize Hobbido and any third-party firms that we use to process your earnings Payout to collect and store your personal information, banking and financial instrument information. Hobbido may also share your information with governmental authorities as required by applicable law. Such information may include but is not limited to your full name, nationality, bank account number, bank name & branch, country of residence, age, contact information, copy of your verification documents, etc.

 

  • Hobbido Platform allows you to easily track and monitor all your earnings under the “My Earnings” section. You can also check all transactions and submit any support ticket if required.

 

  • You can initiate a Payout Request from the “My Earnings” section of the Hobbido Platform, only Earnings which have reached the minimum set threshold can be requested.

 

  • The default minimum threshold for new Host User accounts is 500$ unless otherwise stated.
  • After you request a Payout for your Eligible Earnings, the request will be placed in the queue for the next Payout cycle, which is usually 14th or 27th day of each month.
  1. Fees

 

  • Unless otherwise agreed, the default Hobbido Service Fee for each booking is 20% of the total booking amount which is automatically deducted during the confirmation of any booking. Your ‘My Earnings’ section will reflect the money you have received from each confirmed booking minus the Hobbido Service Fee and any applicable Taxes. The Hobbido Service Fee is subject to change at any time as Hobbido sees fit in order to continue to provide such services.

 

  • You can opt-out of providing Hosting Services on the Hobbido Platform at any time by submitting a support ticket, However, you must know that in order for our team to support you in your request, you must:
  • Fulfill and undertake all confirmed bookings on your Listings
  • Transfer and clear all of your Eligible Earnings to your selected Payout Method.

 

 

 

  • The Payout Threshold reflects the minimum amount of earnings that are eligible for Payout Transfer to your selected Payout Method. Your Payout Threshold can be viewed in your “My Earnings” section of the Hobbido Platform.

 

For example, if you have zero earnings and you have just successfully completed your first Hosting Services session for a total of 300$, within 72 hours of the start time of session; the 300$ will be transferred to your Eligible Earnings. But as it is below your set threshold (which is by default 500$), you cannot request for Payout.

 

Furthermore, if you have completed your second Hosting Services session for a total of 300$, within 72 hours from the start time; the 300$ will be added to your Eligible Earnings. Now you have 600$ which is eligible to be transferred to your selected Payout Method.

 

  • We are always flexible and understanding, you can contact us through our Help Center if you wish to adjust your set payout threshold.

 

  • Hobbido and the third-party Payout processors may temporarily place a hold, suspend, or cancel any Payout for purposes of preventing unlawful activity or fraud, risk assessment, security, or completing an investigation; or if we are unable to verify your identity when needed. Furthermore, Hobbido may temporarily place a hold on, suspend, or delay initiating or processing any Payout to resolve a dispute with attendees or due to you cancelling or modifying a high-volume of Bookings without justification. You need to ensure your availability to be contacted by Hobbido Accounts in order to solve and rectify any issues before we may be able to process your due Payouts.

 

  • Your Payout may be subject to delays or additional fees applied by your local financial institution. In addition, local or international authorities may impose transaction, currency conversion or other fees based on the currency or Payout Method you select, and Hobbido is not responsible for any such fees or delays and disclaims all liability in this regard.

 

  • For compliance or operational reasons, Hobbido may limit the amount of a Payout. If you are due an amount above that limit, Hobbido may make a series of Payouts (potentially over multiple days) in order to provide your full Payout amount.

 

  • As part of Funds handling, Hobbido, hobbido Inc. or through authorized personnel or firms may combine amounts that it collects from confirmed bookings and invest them as permitted under applicable laws. Hobbido will retain any interest it earns on those investments.

 

  • Your Payout Method information is your responsibility. Hobbido cannot be and will not be responsible or held liable in any way for any loss suffered by you as a result of incorrect Payout Method information provided by you.

 

  • Hobbido will take the necessary steps to rectify any payout processing errors that we become aware of. These steps may include crediting or debiting (as appropriate) the original Payout Method, in-app Wallet or Payout Method used or selected by you, so that you end up receiving the correct amount. This may be performed by Hobbido or a third party such as the Payout gateway or your financial institution. We may also take steps to recover funds sent to you in error (including but not limited to an event of duplicate payouts made to you due to a processing error), by reducing, setting off and/or debiting the amount of such funds from any future Payouts owed to you.

 

  • Should you receive any funds in error, you agree to immediately return such funds to Hobbido.

 

  1. Appointment of Hobbido as Limited Payment Collection Agent

 

  • Each Host, including each Host Team member where applicable, hereby appoints Hobbido (“hobbido Inc.”) a General Corporation in the State of Delaware, USA. as the Host’s payment collection agent solely for the limited purpose of accepting and processing funds from booking users who are purchasing Host Services on the Host’s behalf.

 

  • Each Host, including each Host Team member where applicable, agrees that any payment made by booking Users through the Hobbido Platform, shall be considered the same as a payment made directly to the Host User, and the Host User will provide the Hosting Service booked by such User in the agreed-upon manner and as described in the Hosting Service Listing as if the Host has received the payment directly from the User. Each Host agrees that Hobbido may refund the booking User in accordance with the terms stipulated in this document or Hobbido’s General Terms of Use. Each Host understands that Hobbido’s obligation to pay the Host User is subject to and conditional upon successful receipt of the associated payments from confirmed bookings users. Hobbido guarantees payments to Host Users only for such amounts that have been successfully received by Hobbido and through Hobbido Platform from Users in accordance with these Payments Terms. In accepting appointment as the limited payment collection agent of the Host, Hobbido assumes no liability for any acts or omissions of the Host.

 

  • Each Host acknowledges and agrees that, notwithstanding the fact that Hobbido is not a party to the agreement between you and the booking user(s), including each Host Team member, Hobbido acts as each Host User payment collection agent for the limited purpose of accepting payments from users on your behalf.

 

  • Upon a user’s payment of the funds on the Hobbido Platform for the purchased Hosting Service(s), the user’s payment obligation to the Host(s) for the agreed upon amount is extinguished, and Hobbido is responsible for remitting the funds successfully received by Hobbido and on its Platform to the Host User in the manner described in these Terms. In the event that Hobbido does not remit any such amounts, the Host User will have recourse only against Hobbido and not the booking user directly.

 

  1. Moral ethics and Community Policy

 

Hobbido is an open community dedicated to bringing the world closer together by allowing its Users to browse, search, book and attend various activities in their city, country or worldwide and allow experienced Host Users to earn money by providing Hosting Services that might include hobbies, sports, wellness, outdoor activities, excursions, cultural education, life coaching and others. We target to build a community that will include people from virtually every country on the globe with diverse backgrounds, cultures, values, and norms.

Hobbido is committed to building a world where people from every background feel welcome and respected, no matter where they come from and where they are going. This commitment rests on two foundational principles that apply both to Hobbido’s Host Users and attendees: inclusion and respect. Our shared commitment to these principles enables all members of our community to feel welcome on the Hobbido Platform no matter who they are, where they come from, how they worship, or whom they love. Hobbido recognizes that some jurisdictions permit, or require, distinctions among individuals based on factors such as national origin, gender, marital status or sexual orientation, and it does not require Host Users to violate local laws or take actions that may subject them to legal liability. Hobbido will provide additional guidance and adjust these terms to reflect such permissions and requirements in the jurisdictions where they exist.

While we do not believe that one company can mandate harmony among all people, we do believe that our users and hosts can promote empathy and understanding across all cultures. We are all committed to doing everything we can to help eliminate all forms of unlawful bias, discrimination, and intolerance from our platform. We want to promote a culture within the Hobbido community—Host Users, guests and people just considering whether to use our platform—that goes above and beyond mere compliance. To that end, all of us, Hobbido employees, hosting users and guests alike, agree to read and act in accordance with the following terms to strengthen the Hobbido community and realize our mission of ensuring that everyone can belong, and feels welcome, anywhere.

As such, you as a Hobbido Host User may not

  • Decline a booking based on race, color, ethnicity, national origin, religion, sexual orientation, gender identity, or marital status.
  • Impose any different terms or conditions based on gender
  • Post any listing or make any statement that discourages or indicates a preference for or against any guest on account of gender.
  • Decline a user booking based on any actual or perceived disability unless otherwise stated in the listing that such activity is not intended or convenient for any person with specific disability.
  • Charge more in fees for guests with disabilities, including pet fees when the guest has an assistance animal (such as a service or emotional support animal) because of the disability.

 

 

  1. Local norms, culture, laws and ethics

 

As the Hobbido Platform is intended and available to be used worldwide, we understand that each country has its own culture, ethics and laws and for this Hobbido does not encourage Hosts who are providing Hosting Services in those countries to break the law in order to comply with these terms.

 

However, it is the Hosting User responsibility to ensure that any Hosting Services clearly list any specific requirements that need to be met. This can be applicable to gender specific access to venues or sessions, dress code, profanity, consumption of alcoholic beverages, and verbal insults, or any other requirement. The Host is also requested to conduct an introductory discussion with all attending users to his Hosting Service Sessions about what is allowed and what is not.

 

In the event, all requirements and laws have been explicitly introduced to users in the listing and the user did not comply, then the Host is permitted to refuse the admittance of the user on that basis.

 

  1. Miscellaneous

 

  • There is no waiver on these terms. Hobbido’s failure to enforce any right or provision in these terms will not constitute a waiver of such right or provision unless acknowledged and agreed to by us in writing. Except as expressly set forth in these terms, the exercise by either party of any of its remedies under these terms will be without prejudice to its other remedies under these terms or otherwise permitted under law.

 

  • You may not assign, transfer, or delegate this agreement or your rights and obligations hereunder without Hobbido’s prior written consent. Hobbido may without restriction assign, transfer, or delegate this agreement and any rights and obligations, at its sole discretion, with two (2) months’ prior notice.

 

  • Unless specified otherwise, any notices or other communications permitted or required under this agreement, will be in writing and given by Hobbido via email or Hobbido Platform notification, and depending on your notification setting, messaging service. The date of receipt will be deemed the date on which Hobbido transmits the notice.

 

  • Except as otherwise required by applicable law, Hobbido may modify these terms at any time. If we make material changes to these terms, we will post the revised terms on the Hobbido Platform and update the “Last Updated” date at the top of these terms. If you do not terminate your agreement after the new terms become effective, your continued use of the Hobbido Platform will constitute acceptance of any changes to the revised Payments.
